Consumer Terms of Sale

PLEASE READ THESE TERMS CAREFULLY! THEY INCLUDE AN ARBITRATION PROVISION REQUIRING INDIVIDUAL ARBITRATION OF DISPUTES INSTEAD OF JURY TRIALS OR CLASS ACTIONS. By submitting your order or accepting or using products, you acknowledge that you agree to these terms in their entirety.

1. Application. These Consumer Terms of Sale (“Terms”) apply to all consumer purchases from One PC or of One PC products, software, services or support (“Product”) in the United States.
2. Additional Terms. The Terms consist of this document and One PC’s:

3. Orders, Acceptance and Cancellation. Your order noncancellable. One PC may send an order confirmation email to acknowledge receipt of your order. One PC may process payment for and ship parts of an order separately. One PC reserves the right at any time, even after we send you a confirmation email, to decline or cancel your order or to limit order quantities for any reason, including errors or suspected fraud.
4. Pricing and Availability. Prices and promotions are subject to change. One PC strives to communicate accurate pricing and product information, but errors may occur. In the unlikely event that an error impacts your order, or a Product ordered is no longer available, we will either contact you for instructions or cancel your order.
5. Taxes and Fees. You are responsible for sales and other taxes associated with your order.
6. Shipping. Product title passes to you when the Product ships. You are responsible for inspecting the package(s) upon delivery and must note any visible damage on the proof of delivery (POD) or other delivery receipt the carrier asks you to sign. One PC is not responsible for any visible shipping damages not noted on the delivery receipt.
7. Receiving Service Support. IT IS YOUR RESPONSIBILITY TO BACK UP ALL EXISTING DATA, SOFTWARE AND PROGRAMS BEFORE RECEIVING SERVICES OR SUPPORT (INCLUDING TELEPHONE SUPPORT). ONE PC AND/OR YOUR THIRD-PARTY SERVICE PROVIDER WILL HAVE NO LIABILITY FOR LOSS OR RECOVERY OF DATA OR PROGRAMS, OR FOR LOSS OF USE OF SYSTEM(S) ARISING OUT OF THE SERVICES OR SUPPORT OR ANY ACT OR OMISSION, INCLUDING NEGLIGENCE, BY ONE PC OR YOUR-THIRD-PARTY SERVICE PROVIDER. Parts used in repairing or servicing Product(s) may be new, equivalent-to-new, or reconditioned.
8. Telephone Communications. Telephone communications with us, our agents or independent contractors may be monitored and/or recorded. You expressly consent, on behalf of yourself and other users of your phone number, to such monitoring or recording. By providing us with a phone number (including mobile) as your contact number, you expressly authorize us to contact you on that number via text message or telephone, including via prerecorded or auto-dialed calls. This consent is for non-telemarketing calls only.
9. Limitation of Liability. In no event will One PC be liable for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, even if One PC has been advised of the possibility of such damages. YOU AGREE THAT ONE PC’S LIABILITY IN ANY DISPUTE WILL BE CAPPED AT THE TOTAL AMOUNT YOU PAID FOR THE ORDER OR PRODUCT AT ISSUE. Some states do not allow limitation of certain damages, so these limitations may not apply to you. If you are a New Jersey resident, this provision will not apply to claims for damages caused by One PC’s intentional, reckless or grossly negligent conduct.
10. Purchases may not be resold or exported. Your purchase is for your own use, not for resale, export, re-export or transfer. Your purchase is subject to and you are responsible for compliance with the export control and economic sanctions laws of the United States and other applicable jurisdictions (“Export Laws”). Your purchase, including any associated intellectual property rights or trade secrets that may accompany it, may not be used, licensed, sold, supplied, leased, exported, re-exported or otherwise transferred, whether directly or indirectly, to restricted countries (including, but not limited to Cuba, Iran, North Korea, Syria, Russia, Belarus, and the Crimea, Donetsk, and Luhansk regions of Ukraine), restricted end users, or for restricted end uses according to the Export Laws. One PC reserves all rights and remedies to enforce these restrictions, including injunctive relief, damages, and cancellation/termination of your purchase.
11. Governing Law. THESE TERMS AND ANY DISPUTE BETWEEN YOU AND ONE PC WILL BE GOVERNED BY THE LAWS OF THE STATE OF TEXAS, WITHOUT REGARD TO CONFLICTS OF LAW.
12. Dispute Resolution and Binding Arbitration. YOU AND ONE PC AGREE TO RESOLVE ANY DISPUTES BETWEEN US EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS, WHICH MEANS YOU AND ONE PC WAIVE ANY RIGHT TO LITIGATE DISPUTES IN A COURT OR BEFORE A JURY, OR AS PART OF A CLASS ACTION, A REPRESENTATIVE ACTION, A CONSOLIDATED ACTION OR IN A PRIVATE ATTORNEY GENERAL CAPACITY, EXCEPT AS SPECIFIED IN ANY APPLICABLE MASS ARBITRATION RULES, PROCEDURES, OR GUIDELINES.
a. This arbitration requirement applies to any claim or dispute of any kind (whether in contract, tort, or otherwise, whether pre-existing, present, or future, and including statutory, common law, or equitable) between you and One PC, its agents, employees, successors, assigns, direct and indirect subsidiaries, and any third party providing any products or services to you in connection with your purchase ("One PC") that relates in any way to your purchase or Product, these Terms, or One PC's marketing or advertising (“Claims”).
b. You still have the right to bring individual Claims in small claims court, to the extent that you qualify.
c. One PC will pay the arbitration/arbitrator fees.
d. Arbitration shall be administered by either:
i. The American Arbitration Association (AAA), subject to its Consumer Arbitration Rules, available at (800) 778-7879 and www.adr.org; or
ii. JAMS, subject to the JAMS Comprehensive Arbitration Rules, available at (800) 352-5267 and www.jamsadr.com.
e. If more than 25 individual arbitration demands are filed by the same or related parties or party representatives, the Mass Arbitration Supplementary Rules (AAA) or Mass Arbitration Procedures and Guidelines (JAMS) will apply.
f. The arbitrator shall have exclusive authority to resolve any arbitrability issues including any dispute over these Terms or this arbitration provision’s scope, application, meaning, and enforceability. The arbitrator shall be empowered to grant whatever relief would be available in court. Any award of the arbitrator(s) shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
g. You and One PC agree to arbitration only on an individual basis, except as specified in any applicable mass arbitration rules, procedures, or guidelines. Neither you nor One PC may join or consolidate claims of others or participate in any claim as a class representative or a class member. If any portion of this arbitration agreement is found unenforceable, the unenforceable portion shall be severed and the remaining arbitration terms shall be enforced (but in no event will there be a class arbitration). This Paragraph controls over any inconsistent term in any other agreement.
h. This transaction shall be governed by the Federal Arbitration Act 9 U.S.C. sec. 1-16 (FAA).
Return Policy
One PC values its relationship with you and offers you the option to return most products purchased directly from One PC.  More details below.
This policy does not permit returns from commercial customers who made their purchase by issuing a Purchase Order to One PC (inclusive of online purchase orders) or on payment terms.
For all eligible purchases, our return policy is 30 days from the date of your invoice, unless you have a separate agreement with One PC. You must initiate the return within this time. If approved, you will receive a credit return authorization (CRA) number from One PC. Some exclusions apply as outlined below.
One PC sometimes offers promotions that extend the return period for a specific product. If you buy a product from One PC that qualifies for such a promotion, your return rights and obligations might be different.
For approved returns, One PC will refund or credit the actual price you paid. Your refund or credit may be reduced by the cost of shipping and handling fees, any applicable restocking fees (described later in this policy), or both. View more details on restocking fees below.
Any product returned to One PC without a CRA number from One PC will be considered an unauthorized return, and you will not receive a refund or credit for the product and One PC will not ship the product back to you.
Return the products in their original packaging, in as-new condition, along with any media, documentation and any other items that were included in your original shipment.
Ship your return in time for us to receive it within 30 days of authorization or your refund or credit may be reduced or eliminated.
Special conditions apply for products purchased in a bundle or during a promotion. See “Promotional Items” section below.
For all purchases not made directly from One PC, please check the return policy of the location from which you purchased your product.
All returns must be made in the same country in which the purchase was made.
the product you are returning is defective.
you have to return a product because One PC made an error.
you are a consumer who purchased for personal use.
For all other permitted returns, One PC may charge a re-stocking fee of up to 50% of the actual price you paid for the product. That price does not include shipping and handling or sales tax. Typically, we deduct any re-stocking fee from the amount of your refund or credit.
All products should be in as-new condition. In particular, review “A note about operating systems” at the end of this policy.
Back up any data you might have stored on your product and then delete it.
Remove all confidential, proprietary, and personal information.
Also remove any media such as flash drives, CDs, or PC cards and any cables or port devices that did not come with the product you are returning.
Ship all products that you are returning to One PC, within 30 days of the date that One PC authorizes your return.
Return all products, along with all media, documentation, and other items that One PC included in your original shipment, in their original packaging.
You must ship the products at your expense insured for original purchase price.
Also remember that One PC is not responsible for any confidential, proprietary, or personal information you leave on a returned product. We also are not responsible for lost or corrupted data, or for any damaged or lost removable media or devices you might include with your return.
A note about operating systems.
Systems are designed to run optimally with the Microsoft Windows 11 operating system. Removing the factory-installed operating system to run a non-Windows 11 operating system (such as Windows XP or Windows 10) may make the product ineligible for return to One PC for a refund. It also can cause system instability and performance issues that your warranty, support, or service agreements may not cover.
